Fitzpatrick court cases continued

A set of court dates have been continued for a 21-year-old Spencer man charged in the beating death of Edward Kitto.

Chris Fitzpatrick will appear in the Clay County Courthouse at 2 p.m. on Dec. 3 for a pre-trial hearing regarding the class A felony first-degree murder charge filed against him. That hearing was initially set for Tuesday, as was a Dec. 11 jury trial date. A new jury trial date has not been set.

Fitzpatrick is also scheduled for a pretrial hearing in reference to a class B felony charge of first-degree robbery and a class C felony charge of willful injury. That hearing is set for 9:30 a.m. on Jan. 15, with a jury trial set for 9:30 a.m. Feb. 26.

Fitzpatrick was initially charged with willful injury for his alleged role in an early morning beating on Aug. 28, with the robbery charge added two days later.

The first-degree murder charge was filed following the death of Kitto on Sept. 8.

The 59-year-old Ruthven man had been found unresponsive in the 500 block of East Third Street and never regained consciousness.
