Second man charged in connection with Kitto death

Millard faces first degree murder

In continuing the investigation of the beating death of 59-year-old Edward Kitto, Cody Millard, 21, of Spencer, has been charged with first degree murder.

Millard was arrested at his place of employment by the Dickinson County Sheriff Thursday. He is being held on $250,000 bond.

Millard joins 21-year-old Chris Fitzpatrick, of Spencer, who is also accused of first degree murder charges for his alleged role in the death of Kitto.

Kitto, of Ruthven, was found unresponsive in the 500 block of East Third Street on Aug. 28, and never regained consciousness. He passed away Saturday, Sept. 8, in a Sioux Falls hospital.

Fitzpatrick entered a not guilty plea Friday, Sept. 21, and was arraigned on Monday. He waived his right to a speedy trial.

The Spencer Police Department has been assisted by the Clay County Attorneys office, Dickinson County Sheriff and Department of Criminal Investigation in its ongoing investigation.

  • I guess I'm glad to see that Fitz, as many call him,isn't going to end up sitting and being the only one charged in this case when apparently others were involved! I understand what Fitz has done is wrong but don't feel that if he didn't act alone that he should be the only one tried for it.

  • Fitzsupporter, I do remember some of those 72 comments coming from "friends" claiming this was a race issue and Fitz did nothing wrong. And now that a second person is being charged with 1st Degree murder, it doesnt sound like Fitz was so innocent in this issue like everyone had tried to say.

    Im glad to see the Spencer PD are fully investigating this situation and making more arrests.

    With that said, my thoughts go out to Kitto's family as well as Chris's and Cody's family as this whole mess is getting more and more clear.

  • Good point Fitz supporter, everyone was wrong to judge him for the crime. Now that we know he didn't act alone and had help, we realize we shouldn't judge. He is less of a criminal now that we know he had help. I hope you are picking up on the sarcasm here.

    If you want my opinion it is even worse that more than one of these little degenerates ganged up on the man and stole from him and beat him to death.

  • @fitzsupporter - Did anyone on that thread indicate that Mr. Fitzpatrick acted alone? If not, I'm not sure your argument makes sense.

  • I don't know him, but as I look at the photo, he's not smiling. His eyes are terrified. Like it's just hit him that he's a 21 year old man who's wasted his life with one night's actions. I have no idea what really happened, but my thoughts are with the families of all three.

  • We were all too quick to judge. Had we known it was a group that mugged the old man, we could have condemned these individuals for this even more heinous act.

    I like how defenders were on here weeks ago hinting they knew there was more to the story. If that's the case they should have been at the police station giving the names of everyone involved instead of going by their fake gangster code of silence.

  • First of all not a smile on Codys face. Secondly downwithdems how incompetent can one person be. To say that they are related to the guy form the Colorado massacre. Completely an uneducated comment. I know Cody and have know him since he was a little kid. No I don't know any facts but to me they both need a change of venue because they're are no unbiased people here in this area to be on the jury. Since thelast comment I made was erased from the Chris Fitzpatrick story. I think that downwithdems comment should be erased for its idiotic comment equating these two to the guy from Colorado. Plus how would you all feel if it was your friend, brother, son, family member. Lots of people like to pass judgement around here.
