Judge Don Courtney found former Estherville restaurant owner Juan Humberto Castillo-Alvarez responsible for orchestrating Erickson's death, based on a January 2008 ruling at the Palo Alto County Courthouse in Emmetsburg.
Castillo-Alvarez awaited appeal while serving a 50-year sentence for second-degree murder, second-degree kidnapping and conspiracy to commit a forcible felony.
The District Court conviction was overturned in September, with a split decision from the Iowa Court of Appeals.
"We disagree with the decision of the Court of Appeals," Houchins said. "We were hoping for further review. But, for whatever reason, they (the Iowa Supreme Court) decided not to do that. So, unfortunately the ringleader of Sky Erickson's death is not going to be held accountable in the state of Iowa."
Castillo-Alvarez fled to Mexico as co-conspirators were questioned and his restaurant was being searched for evidence more than 12 years ago. He was in hiding for a decade in Mexico before court filings from the Clay County Attorney's Office led to Castillo-Alvarez's apprehension south of the border.
The same filings, which paved the way for extradition back to Iowa, also started the clock on the defendant's right to a speedy trial. Castillo-Alvarez did not waive his right to respond to charges within 90 days.
"We're flabbergasted that the guy flees the country to avoid prosecution, then we finally locate him -- and once we arrest him, he fights extradition for a year," Houchins said. "He gets up here (to Iowa), and then all of the sudden, he claims 'I want a speedy trial.' It's just absurd."
Erickson's mother, Joni Ketter said she is "actually a little disgusted," to see the Clay County convictions dismissed. Like Houchins, she received word Thursday of the Iowa Supreme Court's decision to deny further review.
"I understand the philosophy behind ensuring a defendant has a right to a speedy trial," she said. "But I think that if he was really concerned about having a speedy trial he wouldn't have ditched his pregnant wife and young child to flee the country. If he really wanted his day in court, he would have stayed in this country and faced those charges head-on. If he was really innocent, he wouldn't have been afraid to face those charges. By denying review, they are allowing a murderer to potentially go free."
ABOUT THE CASE
Castillo-Alvarez was the last of 10 people charged in the June 1997 plot to end 15-year-old Erickson's life over an unpaid drug debt and his possible role as a police informant.
He was in the United States illegally and operated a Estherville restaurant under his brother's name, Ricardo Castillo. Testimony suggests the Mexico Lindo restaurant also served as a front for his drug operation.
Drugs were stored in a broken cooler, marijuana and methamphetamine left the building in food take-out bags and weapons, including the gun used to kill Erickson, were hidden above the ceiling tiles.
Erickson was drawn into the drug culture after becoming friends with members of Castillo-Alvarez's inner circle -- a gang called Los Crazy Boyz.
In the morning or early afternoon hours of June 6, 1997, five of the gang members gathered at a residence in Estherville. Two carloads of gang members then went to Spencer to find Erickson.
The teenager was taken into a bedroom and beaten by a couple of gang enforcers in a Spencer apartment. The gun was pointed at his head and fired without ammunition. It was also shoved down Erickson's throat, causing him to vomit.

Testimony suggests a group of five gang members received the following instructions from Castillo-Alvarez: Take Sky out to the country and punish him. The group went to Fort Defiance State Park in Estherville, then drove to an area near Swan Lake, which is close to the town of Superior.
Erickson was severely beaten at the Dickinson County location. Lua pulled out a gun and was ready to shoot him. He was talked out of it by other gang members, who suggested a better location.
Erickson was then thrown into the trunk of the car and taken to an abandoned farmhouse in Jackson County, Minn., where he was killed. Lua was convicted of murder for firing the bullet responsible for Erickson's death.
The gang tried to destroy evidence by starting a fire at the farmhouse and the murder weapon was eventually returned to Castillo-Alvarez. A property owner came across the crime scene, less than two miles north the Iowa border, on June 14, 1997.
NEW CHARGES POSSIBLE
The suspected drug operation in Emmet County and an abduction that crossed state lines could lead to a fresh set of charges, according to Houchins.
We're are not going to let him walk out of the jail free without a fight," the Clay County attorney said. "What I mean by that is: I visited with (Assistant Iowa Attorney General) Chuck Thoman, who is the prosecutor who actually tried the case here in Clay County ... this (Friday) morning, we've been on the phone, we've contacted the Federal Bureau of Investigation, and the U.S. Attorney's Office to see if there are possibly federal charges that could be filed against Castillo. Secondarily, we've contacted Minnesota (Friday morning)."
The prosecutors from Iowa have asked agents from the Bureau of Criminal Investigation in Minnesota if they would consider murder charges in the state of Minnesota against Castillo-Alvarez.

"The preliminary conversations were that he wanted to pursue that and will be visiting with the Minnesota Attorney General's Office to look at the likelihood of filing murder charges in the state of Minnesota," Houchins said. "That's what we're looking at."
In the meantime, Houchins said Castillo-Alvarez will remain detained at the State Correctional Facility in Newton.
"Beside our charges, there are two separate holds on Castillo," Houchins said. "Emmet County (in Estherville) still has warrants out for his arrest for drug charges. So, there is an Emmet County hold on him. Secondarily, ICE (Immigration and Customs Enforcement) has a hold on him, too. Obviously he was here illegally at the time the murder took place. He was using his brother's name, Ricardo Castillo. It's not a situation whereby he's going to walk out of the prison doors and be loose in our community."
Bob Brammer, a spokesman for the Iowa Attorney General's Office issued a statement late Friday, saying: "We understand Emmet County has active warrants for Mr. Castillo-Alvarez's arrest on other state charges. We expect Emmet County will take him into custody and that those matters would be resolved before the federal detainer is imposed."
The state of Minnesota and the federal government will have to look at whether or not they can legally proceed with a fresh murder investigation, according to Houchins.
"I think they could still put the evidence together to try him, but they're going to have to make that decision as to whether or not there still is enough evidence that can support whatever charges they may levy against him," he said. "There's a legal question and there's a factual question. If they feel they can satisfy both of those, then hopefully they'll prosecute this guy."

I think so many mistakes were made from the start that maybe some responsibility needs to be taken by the authorities instead of thinking of ways to continue with new prosecution.
It's ridiculous how they justify not giving a man his right to a speedy trial and even after a ruling and refusal to review still insist they did things right.
How on Earth can one expect a speedy trial when they are using every method to hide from prosecution. Slip out of the country into Mexico. Escape from custody with the help of your south of the boarder friends at the police station. Employ every method to avoid extradition and all at US taxpayer expense? What a country?

There was no reason that trial information was filed when the guy wasn't in this country or in custody. That alone is the reason why his right was broken. Nor did the prosecution need to file trial info. to arrest or extradite. Lawyers should know that!There would have been no issue if once he was in custody, then they filed the info. We can't pick and choose who gets that right. I think the lawyers should be sued for their mistakes, or have they been sued already?

You of course miss the point. Someone who is not a citizen of this country and is not here legally should not be entitled to the same rights of a legal citizen. He broke the law being here, and then broke more laws while he was here. He should not have a fair trial among a jury of his peers. A jury of his peers is 12 crooks just like him. First of all for all the money they pay in they are double the burden on our tax system. I am far from a racist, how does not wanting people that have no legal right to be in this country make me a racist. If you are so excited about Mexico, then move back there. The point is he was here illegally. That is a crime. He is not a citizen of our country. He should not be treated as such. Simple. Yes the people who come here often have a great work ethic and are willing to do jobs that some of our citizens are not. I think that is great, however they should come here by legal means. I hate to say it because I'm not going to be very popular, but the community needs to MOVE ON. There are current crimes and current drug dealers. It's not that I don't care, but I don't want to keep reading over and over the same story.
Some hispanics are citizens, but a lot of the problem comes from those who are not. I would condemn you if you were stealing to feed your family. latinasmom if that was your son you would not be saying move on. A view point the jails do charge for locking you up, and hospitals charge if you don't have insurance. However these criminal types don't have money to pay, so who flips the bill? I do, for sure, I am pretty sure you don't. You sound like someone with their hand out.
These laws need to be enforced with no loop holes. We let people walk the street that have no business doing so. I am not sure what slavery and killing of indians has to do with keeping illegals out of our country. Yes we exterminated Indians, that is how every country has been established throughout time. Think about it. Slavery was not eliminated immediately because we needed to have all hands on deck to gain our Independence. Our founders knew that over time it would correct itself. I am not surprised to hear you assume that I must be on the dole. I think you make too many assumptions about a lot of things, and that may be the only reason I bother with you. As for bringing jobs back I said, that we need to return jobs to this hemisphere, meaning places like Mexico and Haiti, so that illegal emigration could be lessened. Look it up but we did not go to war over slavery. It was not until long after the war began that freeing of slaves became a thought. The south wanted to be it's own nation and the north like England before did not want to allow that to happen. Slavery was not the issue. When a nation is to expand it needs resources. We got our land by taking it, like the Egyptians, the Greeks, the Romans, the Mongols, England, .... That is how it works and how it will always work. It works that way in the animal kingdom(which is what we are), the dominant species wins. As far as raping the Earth for resources without the thought of tomorrow, go hug a tree. There are more of them in the US today than when the Pilgrims landed. Without our desire to obtain more, think of where the world would be. You wouldn't have electricity, a car, or many of the other things you require to survive. You would be dead at age 40-45. That is the life that I want. I do not apologize for what we have done, because our country has advanced our species beyond imagination. Business is going to go where it can be most profitable. That is not here for a lot of businesses. Until we provide the incentives for companies to stay here they should leave.

I do not assume much. I look at numbers and use logic. Illegal is Illegal. Maybe you do not think it should be a crime for people to come here, but that is not the point. It is illegal for people not to be here without permission. You may think it ok to smoke weed, but it is illegal. Unfortunately people in this country have not seen the economic struggles that are coming. When the average middle class person with a home pays nearly 50% of their wages in taxes it is absurd(income, sales, property, registration etc). Now they might finally get outraged as I am about all the able body dead beats that have been living off taxpayer money for years. Maybe we will quit building new schools and courthouses and decide that we can downsize to 10 counties.
All that being said, the simple fact is Someone who is not a citizen of this country should not be entitled to the same rights. We would not be treated with the same respect. Despite your we are the world theory, the world is a better place when we have an us vs the world approach. We are a safer nation and a more unified productive nation.
While I do agree with the fact a drug addict came to the end that drug addicts come to. A suspected murderer should come to the end that a murderer comes to, if convicted. The fact that he ran and hid and is able to get off through a ridiculous loophole that he should not be afforded because he is a citizen should outrage everyone. If he hadn't ran away and we hadn't try to bring him to justice, it would be a different story.
I am glad that it is hard to come here legally. It should be. It should not be an open door. I do know because I have two family members that Are trying to come here legally. Whether or not companies pay a decent wage is a idiotic argument. They pay the going wage where ever they are located. Its called economics(I realize you may not understand). A Painter in California makes $70/hr, what does a painter in Spencer make. Not half that. Even if they came here and we did not waste all the money and resources putting spanish everywhere. You just wait it wont be long before they start complaining about not getting their Social Security, and you know what we will probably then give it to them. We all make mistakes and need to be punished for them. Sky was a young kid who may or may not have been able to straighten out his life. His life was cut short by someone, and now we may let the best suspect walk.
The fact is, were it not for the slavery issue, there would have been no civil war. The South knew that they would be giving up their slaves in the near future, Lincoln had mentioned such in his campaigning and previous writings concern how uncivilized it was. Here is a fact....Sky was killed, the police did not protect him when he was clearly in danger, and that this case is still going on for 12.5 years is amazing to me.
Yes there was extradition issues, but once Castillo returned, the attorneys should have been ready to present their case at the earliest time possible.

That is another messed up issue I'm glad you brought up Mr. Castillo. The jail house snitch. Who is he? He's a criminal, also illegal and to put it nicely a whack job. I couldn't believe it when that came out in the paper.He testified that not only was he NOT receiving a deal in return for testimony, but would not accept a deal. Has anyone checked on his outcome? He had several counts of robbery.

This child was lost because of our local law enforcements thinking they had it all in the bag. That 'big bad cop', seen-on-TV attitude. They did not think ahead, the parents were NOT parents but donors if they let this go on. This child was FIFTEEN YEARS OLD! Illegal or not everyone that works in the USA pays taxes. If the social security number is false they are still paying taxes on it. Taxes that will never be claimed. They work hard jobs and make good pay for their standards. Maybe we can learn something from them and lower our living standards and realize that there are not 'rights' only 'privileges'. Only right we have is the right to be judged by our Lord.
nobody has any idea about what happened and who said what, unless you was there. wether sky was doing wrong, or not, he should have never died! that is the ultimate sin! castillo should have to answer for his role too. It was his gun, and he had possession of it after the fact.
I hope that the Government indicts him!!!!!
He only won his appeal on a technicality!!!!
He needs to pay for what he's done!!!!! He's a loser!
The reason he won his appeal was not a technicality....It was something more powerful that many of us can't understand....but it is called the power of GOD, if we read the bible more we can find answers of what happens when you pray we all should try it once in a while maybe our miracle is just standing there never know...Bless all of your hearts.
Another thing don't you think GOD already paid for our sins in the cross? I am telling you we are very judgemental but before we all point fingers remember there are 3 pointing back at us....
Don't worry. This isn't over yet. He will see yet another day in court and justice will be done. It's great that he has found God. Too bad he didn't do that before he was dealing massive amounts of drugs to young people in our communities.
And the charges were filed today.
