An Everly man is awaiting a court date after investigators suspect he was trying to obtain a prescribed medication illegally.

Police took David Jack Easton into custody on Thursday and three counts of obtaining a prescription drug by fraud were filed against the 55-year-old at the Clay County Courthouse on Friday.

Members of the Spencer Police Department think Easton did not have a valid prescription for 101 tablets of Alprazolam. The drug also is known under the brand name Xanax and is prescribed to patients who suffer from anxiety disorders, including panic attacks and anxiety associated with depression.

Officers believe Easton tried to obtain the Alprazolam on more than one occasion, including Aug. 10 at Walgreens, where he was a pharmacist. He was using the drug for his personal use, according to allegations in court records.

Three separate charges were filed because officers suspect the drug was removed from the store on multiple occasions.

"It was a situation that they had missing prescriptions at Walgreens and they brought in a surveillance crew -- a private security crew -- and they basically discovered it was Dave Easton that was misappropriating the drugs," Clay County Attorney Michael Houchins said.

Easton posted bond and was released. He'll have the opportunity to respond to the charges through future court filings and appearances.
